Terms of Service

1. Agreement to Terms

By accessing, browsing, or purchasing automotive spare parts, fluids, or accessories from NeshAutoTech (operated by NESH MUCHOKI AUTOTECH, Business Registration No. BN-DLSZJ99Z), you agree to be bound by these Terms of Service. If you do not agree to all provisions, you must discontinue use of our platform immediately.

2. Ordering & Contract Formation

Placement of an order via our online checkout constitutes an offer to purchase. A binding sales contract is formed only when:

• M-Pesa or card payment is successfully verified and reconciled.
• You receive an order confirmation message or eTIMS tax invoice number.

We reserve the right to decline, hold, or cancel any order if stock is depleted, if vehicle fitment is incompatible, or if suspicious fraudulent payment activity is detected.

3. Pricing & Typographical Errors

All prices are listed in Kenyan Shillings (KES) inclusive of applicable Value Added Tax (VAT), unless stated otherwise.

Price Error Clause: While we strive for absolute accuracy, occasional clerical or system pricing errors may occur. In the event a product is mistakenly listed at an incorrect price (e.g. Ksh 0 or an obvious pricing defect), NESH MUCHOKI AUTOTECH reserves the right to cancel the order and provide an immediate 100% refund of any amounts paid.

4. Shipping, Dispatch & Risk of Loss

Orders are dispatched from our central hub located at Mihango, Eastern Bypass, Nairobi East, Kenya.

• Nairobi & Surrounds: Same-day or next-day courier delivery depending on order time.
• Nationwide Counties: 24 to 72 hours via bonded national parcel couriers (G4S, Wells Fargo, Matatu Courier saccos).
• Risk of Loss: Passes to the customer upon physical handover and signature at the designated delivery address.

5. Returns & Warranty

All returns and exchanges are governed by our official Returns & Fitment Policy. Customers have 7 days from physical receipt to return eligible, unused parts in sealed original packaging.

Electrical parts (ECUs, sensors, ignition coils) that have been plugged into a vehicle or installed cannot be returned due to the risk of electrical short circuits caused by vehicle wiring faults.

6. Governing Law & Jurisdiction

These Terms of Service and any purchase disputes arising out of your transactions with NESH MUCHOKI AUTOTECH shall be governed by and construed in accordance with the Laws of the Republic of Kenya. The competent courts in Nairobi, Kenya shall have exclusive jurisdiction over any legal proceedings.
